GoPetition - Terms of Use
Definitions:
"User" refers to any individual who loads any material to or from the GoPetition server.
"Member" means any person who authors a petition on the GoPetition site or any person who joins the GoPetition community by opening an account.
TERMS:
(1). User/Member Agreement: In consideration of being allowed to use the Web site facilities provided by GoPetition.com pty ltd, User/Member agrees that User/Member will not:
A. Use petition and forum facilities for any purpose in violation of local, state or national laws of any country;
B. Post material that is copyrighted, unless User/Member owns them or has the permission of the copyright owner to post it;
C. Post material that reveals trade secrets, unless User/Member owns them or has the permission of the owner of the trade secrets to post it;
D. Post material that infringes on any other intellectual property rights of others or on the privacy or publicity rights of others;
E. Post material that could be construed by a reasonable person as threatening, obscene, defamatory, unreasonable, hurtful, harassing, or hateful to another User/Member or any other person or entity;
F. Post advertisements or solicitations of business;
G. Post chain letters or pyramid schemes;
H. Impersonate another person.
I. Submit false User/Member information when creating or signing a petition. GoPetition reserves the right to edit, change or remove petitions or signatures or User information when truthful and accurate User/Member information is not supplied. This includes but is not limited to Name, Address, City, State, postal code and e-mail address. Members may use alias names and nicknames to protect identity as long as such name(s) do not conflict with this clause and these terms of service.
J. In regard to signature management and signature editing, members must not edit a signature in any way that compromises the intent of the signer unless it is to remedy a spelling or grammatical error, remove an obscenity or other illegal material.
(2). In consideration of being allowed to use the Web site facilities provided by GoPetition, each Member agrees to allow GoPetition to publish the Member's name (we allow alias and nick names to protect identity) as the author or the relevant petition on or near the petition created by that Member. A Member's email address will never be displayed publicly by GoPetition. However, if a Member is deemed by GoPetition to be in breach of the Terms and Conditions of this website, the Member's email address and IP address may be released to affected 3rd parties.
(3). Members agree that if a petition is closed it will be archived for signers to see the results. A closed version of all petitions will remain live on the site. Archived petitions allow for data access by signers and targets. Removal of petitions from the site is at the discretion of the administrators. Submissions by email for removal will be considered by the administrators.
(4). License: By posting petitions and other communications, User/Member grants:
A. To GoPetition: A royalty-free, perpetual, irrevocable nonexclusive license to use, reproduce, modify, publish, translate, distribute, perform and display those communications alone or as part of other works in any form, media, or technology whether now known or hereafter developed and sublicense such rights through multiple tiers of licensees for consideration paid by those sublicencees.
B. To Other Users/Members and the general public: The right to access, view, store and reproduce the communications for personal use.
(5). Indemnity: Every User/Member agrees to hold harmless GoPetition and its officers and directors from any and all claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from User/Member use of material posted to any facilities provided by GoPetition or any User/Member breach of the terms of this Agreement, or resulting from User or Member use of the charity nomination facility provided by GoPetition, or resulting from the publication of Members' names and email addresses by GoPetition.
(6). Users and Members agree to comply with the GoPetition Disclaimer.
(7). GoPetition does not warrant or hold out that any charity or charitable cause displayed on the site or nominated on the site by its Members does in any way necessarily endorse or is an affiliate of GoPetition.
(8). Construction: Nothing in the Terms and Conditions shall be construed as reducing or limiting GoPetition's rights or interests as set forth in the Disclaimer, or as expanding GoPetition's duties, obligations or liabilities beyond those provided for in the Terms and Conditions.
(9). GoPetition reserves the right to amend or change the terms and conditions, including this term, without notice and without incurring any liability in relation to such changes.
(10). While the services of GoPetition are generally free, we reserve the right to place a sponsor's advertisement on the same page as a Member's petition. We also reserve the right to post a sponsor's url on a Member's petition. GoPetition may also charge for premium services which may include current services or services that were previously free. Premium services can be introduced or changed without notice to our members. Members acknowledge that GoPetition is not required to provide reasons for any action taken under this clause and GoPetition does not incur any liability in relation to such changes or the introduction or amendment of premium services.
(11). GoPetition reserves the right to change, edit or amend a petition to accommodate the interests of interested parties.
(12). GoPetition reserves the right to remove any petition without notice and without supplying reasons and to withhold or delete the signature list and/or forum of that petition without notice. Members and users acknowledge that GoPetition will have no liability in respect of any action taken under this clause. Members acknowledge that GoPetition is not required to provide reasons for any action taken under this clause.
(13). GoPetition reserves the right to edit all message boards and to moderate any Forum or Topic of discussion. GoPetition also reserves the right to activate a message board on any petition to promote open discussion and public debate. If a Member closes a message board, GoPetition reserves the right to re-open that board to allow users to review their topics and information. Boards that remain open for a substantial period provide an implied right under data access laws for users to access that information. Members may request that GoPetition remove any offensive or illegal topics from a message board connected with the Member's petition.
(14). To protect the integrity of GoPetition, we reserve the right to edit all user and Member submissions before posting on the site. GoPetition also reserves the right to remove any petition that hasn't obtained a signature in any 3 month period.
(15). THE TERMS HEREIN SHALL BE GOVERNED BY THE PROTECTIONS AFFORDED BY THE SUPREME COURT OF CALIFORNIA TO BLOG SITES AGAINST CLAIMS FOR LIBEL OR COPYRIGHT INFRINGEMENT. THIS WEBSITE IS NOT LIABLE FOR ANY SUCH INFRINGEMENTS IN RELATION TO MATERIALS UPLOADED BY MEMBERS. REDRESS AGAINST MEMBER CONTENT LIES WITH DIRECT CLAIMS AGAINST MEMBERS/AUTHORS, NOT THIS WEBSITE.
